General Conditions of sale

Article 1 : OBJECT

The present General Conditions of Sale ("GTC") define the rights and obligations of PRO VSP and the client vis-à-vis of the products presented by PRO VSP on its website www.propiecevsp.fr
This site is published by SARL PRO VSP, limited liability company with a share capital of 15 000,00 Euros, registered with the Register of Commerce and Companies of Montpellier under the number 810 312 710 000 17, whose head office is located ZAE Mas de Garric 2bis rue de l'industrie , 34140 Mèze , France .
These general conditions are applicable to all of the items offered for sale on the site, and are reserved for customers over the age of 18 who have full legal capacity.
Any order of one or more items presented on the site involves consultation and unreserved acceptance by the customer of these General Conditions of Sale ("GTCS") as well as applied rates. These conditions shall prevail over any other document and on the terms and Conditions of Sale (GTS) of the country of the customer.
Any failure on the part of PRO VSP, to any of its obligations, outlined in these General Conditions of Sale (CGV), shall in no case be interpreted, by the client, as a waiver of the terms and Conditions of Sale (GTCS).
The said terms and conditions will be subject to updates or changes without notice. The applicable conditions will be, then, those in effect at the time of conclusion of the contract, that is to say, on the day of registration of the order.



Article 2 : INFORMATION RELATING TO ARTICLES

Articles and promotional offers, present on the site are offered for sale within the limits of available stocks and for the offers, until the end of their validity. The presence of an article on the site does not guarantee its availability in stocks.


The photographs and texts illustrating the articles are for illustrative purposes only, are subject to change without notice and does not enter in the contractual field. Therefore, although represented on the site, with the greatest precision, photographs and texts may, however, contain errors. In this case, the liability of PRO VSP shall not be liable.

The parts sold by PRO VSP ( unless otherwise stated in the description of the product indicating the reference origin ) are spare parts of matching quality , also approved for the maintenance and repair , which correspond to the quality of the components used for the assembly of the vehicle considered , but are not manufactured in accordance with the specifications and production standards provided by the vehicle manufacturer. These parts are referred to on the site play adaptable , are of the same quality but may be, for example, be made from another material or another color.

Products sold by PRO-PIV can only be mounted on vehicles or systems recommended by the manufacturer or the equipment manufacturer by a competent person and under its own responsibility. PRO VSP will in no case be held responsible for the consequences of a bad installation or use of a product that is unsuited to a vehicle.

PRO VSP will honor the orders within the limit of stocks available at PRO VSP and its suppliers. In the case of non-availability of proven product ordered, or in the case of non-acceptance by the client of the delivery time which imposes its non-availability , PRO VSP will propose a replacement product to its customer who will retain full discretion to accept or reject it. In the case where the customer refuses the replacement product, PRO VSP will not in any event to see its committed responsibility because of the unavailability of the ordered product in the stock of the supplier or the manufacturer. In case of unavailability of all or part of the order, and refusal of the delivery or the product replacement by the customer, the refund will be made by Bank Transfer to the account of the customer who placed the order within 30 days from the date of payment of the sums paid by the customer.



Article 3 : ORDER OF ARTICLES

The articles offered for sale are subject to availability. In case of unavailability of a product, the customer will be informed, after the passage of the order, by Email. For some products , the reference to "available" means available at the supplier. The order will be validated after acceptance of payment in full. PRO VSP reserves the right to refuse certain orders, found not valid. In the case of an order for a product available on time and that the customer is notified of this delay as soon as the order , the customer may not cancel the order, insofar as the parts are ordered at the request of the client .

In period of sales , reduced price items are not returnable or exchanged .

PRO VSP reserves the right to cancel or refuse an order in case of dispute with the customer on a previous order.



Article 4 : PRICES OF ITEMS

The prices indicated on the site are in euros and include all taxes (French VAT included) excluding shipping costs. Any change in the legal rate of the French VAT will be reflected on the price of the products presented on the site.
The prices shown may be modified at any time, by PRO VSP.

Article 5 : PAYMENT AND SECURITY

During the settlement of the order, the customer will have the choice between the following payment methods :
- Credit Card
- PayPal ( unless the server is unavailable )
- Bank Transfer

For any credit card transaction, the Customer shall indicate the number on the front of the card, the expiration date of the card and the security code on the back of the card (last three digits). The communication by the Customer of his credit card number is authorization for PRO VSP to debit his account up to the amount of the order. No sending in against-refunding will be accepted, whatever the reason. PRO VSP retains ownership of the article until full payment of the price by the Customer. Purchases are made securely. For payments by bank card (carte bleue, carte bleue visa and e-carte bleue), SystemPay Banque Populaire in charge of the security of the payments. All the information that Clients provide to PRO VSP are strictly protected and ensure compliance and security of each transaction.

For any transaction by Paypal , the customer will be able to pay for his purchases directly on the site. The payment is secured by Paypal France.

For any transaction by bank transfer, the client will pass its order on the site by choosing payment by Bank Transfer, it will only remain to perform the transfer of the amount to the bank details sent by email when the validation of the order. The commands will be validated and processed upon receipt of payment .
In the event of a payment dispute with a client, PRO VSP reserves the right to refuse the order.


Article 6 : DELIVERY

Orders can be delivered anywhere in France, including Corsica. PRO VSP reserves the right to choose the mode of transport to be adequate. The orders will be delivered in France by La Poste Colissimo, TNT or other carrier's equivalent.

The delivery of the products shall be effective only after receipt of the total amount of the order. The products will be delivered to the address indicated by the customer, at the time of the passage of his order. As a result, the coordinates transmitted by the client is believed to be accurate and will not incur, in the event of a dispute, the liability of PRO VSP. In the event of a problem contact information, or other for a delivery by TNT , the return being charged to the company , the customer shall pay the amount of the initial shipping costs multiplied by 2 for a new shipment. To the carrier Colissimo , you only need to adjust the amount of the initial shipping costs. It is the same for a parcel that is not claimed in the relay and returned to the company after the retention period by the relay point.

The delivery times are indicative, corresponding to the delay of delivery once the parcel handed to the carrier. The time given does not constitute a firm commitment on our part. So that these deadlines are met, the client must ensure that you communicate accurate and complete information concerning the address of delivery. Delivery times do not include the period of preparation of the order.

The delivery time for some parts in the supplier stock and non-stock warehouse can be up to ten days.

In the case of an order paid in instalments by credit card , no order cancellation will be possible , due dates are sent directly in the bank as of the date of the order.

For any order, the customer undertakes to check the condition of the product received before he signed the delivery note. Once the signed, PRO VSP will consider that the customer has completed this verification. Any problems or reservations must be notified to the carrier upon delivery and then report to PRO PIV in the two days following the receipt of the product. Without any reservation with the carrier and no appeal will be possible and PRO VSP shall in no case be held responsible and therefore liable for payment of the goods contained in the parcel.



Article 7 : RIGHT OF WITHDRAWAL

Under the provisions of articles L. 121-20 and following of the Consumer Code, the customer has a period of fourteen days to exercise his right of withdrawal without having to justify reasons, from the date of receipt of his order. The expenses of sending and return will be borne by the customer. The products, accompanied by bank account details of the customer, must be returned by Mail, in perfect condition and in their original packaging (including accessories and manual) to the following address : SARL PRO VSP- ZAE Mas de Garric, 1 rue de l'industrie, 34140 Mèze, France.
Refunds will be by credit to the account of the client, within a period of 15 days. In the case of returning a product damaged, incomplete, or damaged, it will be neither exchanged nor refunded.

This right of withdrawal may not apply on the products that are available on time therefore to order ( example : paint spray, etc.) In the case of an order paid in instalments by credit card , no order cancellation will be possible , due dates are sent directly in the bank as of the date of the order.

This right of withdrawal may not apply on discounted products in the sales period .

In case of return of a part of an order for which the customer has received a promotion in part or in full of port charges , the refund amount will be charged to the discount, if any.



Article 8 : COMPLIANCE AND PRODUCT WARRANTY

In the case of non-compliance of the products, we ask the customer to inform us by mail, accompanied by the items concerned, in new condition and in their original packaging, within 15 working days, to the following address : Garage SARL PRO VSP- ZAE Mas de Garric, 2bis rue de l'industrie, 34140 Mèze, France.

For any warranty claim , the shipment is at the customer's expense . In case of acceptance of the guarantee , PRO VSP agrees to ship the new part at his expense.
The customer benefits from the legal provisions, relating to the warranty against hidden defects under article 1641 and following of the civil code.

All of our products ( excluding products ) are guaranteed for 3 months from the date of receipt of the order. The products are fitted only by a professional of the car without a licence are concerned. Products must be returned in their original packaging accompanied by the invoice, and the invoice for the assembly is completed by a professional to the following address SARL PRO VSP- ZAE Mas de Garric, 1 rue de l'industrie, 34140 Mèze, France. We will consider the eligibility of the warranty and in case of acceptance we are committed to send you a new product within 15 working days.



Article 9 : RESERVATION OF title AND cancellation CLAUSE

The ordered products remain the property of PRO VSP, until the customer fulfils its obligations, including that it shall perform the payment in full of the price. Once the transfer of ownership is complete, the risk of loss, theft or damage of goods are the responsibility of the customer.

In the event of a failure, on the part of the purchaser, any of its obligations, the sale will be cancelled as of right and without summons. The articles must be returned to PRO VSP within 48 hours.


Article 10 : PERSONAL INFORMATION

The customer expressly agrees to communicate to PRO VSP his / her personal data so that we can best manage the orders, deliveries and customer relationships.
PRO VSP undertakes not to communicate your personal data to third parties.

It is possible that PRO VSP uses Cookies (files containing information stored on the client hard disk). Cookies facilitate the operations that the client performs on the site. They do not contain confidential information about the client. However, the latter is free to refuse the creation of Cookies.


Article 11 : INTELLECTUAL PROPERTY RIGHT

The site of PRO-PIV as well as its content is protected by the laws in force on copyright and on intellectual property. In accordance with the provisions of the Code of intellectual property, PRO VSP, grants to the customer a license to use the site only in the context of his or her personal use. Any partial or total reproduction of the site or its elements is prohibited (photographs, texts, logos, abbreviations, trademarks, designs, etc.).


Article 12 : FORCE MAJEURE

In the event of partial or total nonperformance of its obligations, caused in the case of an event of force majeure or fortuitous event, PRO VSP will not be responsible.
According to the provisions of article 1148 of the Civil Code force majeure shall be placed in a context of unpredictability and irresistibility.
In way express, are regarded as force majeure :
- Strikes, particularly strikes of means of transportation, communication or postal services ; regulatory restrictions ; attacks...
- Floods, fires, lightning, natural disasters...



Article 13 : APPLICABLE LAW AND JURISDICTION CLAUSE TERRITORIAL JURISDICTION

The present General Conditions of Sale ("GTCS") are written in the French language and fall under the French law. The language of this contract is the French language. In the event of a dispute between the parties, the court having territorial jurisdiction shall be the tribunal de commerce of Montpellier (34) - France.


Article 14 : ACCEPTANCE

The present General Conditions of Sale (GTCS) govern the contractual relationship between PRO-VSP and its customer, both parts accept them without reserve. These General Conditions of Sale ("GTCS") shall prevail over all other conditions appearing in quite other document, except exemption preliminary, express and written of the hand of PRO VSP. The present general and special conditions of sale are subject to change at any time without notice. They are applicable in metropolitan France, including Corsica.


Article 15 : IMPAYES

PRO VSP reserves the right to refuse a delivery or honour an order from a consumer who would not have regulated completely or partially a preceding order or with whom a payment dispute is being of directors.
In the framework of these procedures, our services could be brought to require all the parts required to unblock your order.
